On the importance of the Forum for the formation and development of the intellectual Property Market in the EAEU, CIS and the World
In the Article, on the Basis of the Speech of the Author in the Framework of the Program of the XI International Forum “Innovative Development through intellectual Property Market”, discusses the significance of the annual Forum (2008–2019.) for the Formation and Development of intellectual Property Market in the Eurasian economic Union, the CIS and the World.

Проблемы формирования евразийского рынка интеллектуальной собственности в 2018 г. и приоритеты на перспективу до 2025 г. как условие конкурентоспособности в цифровой экономике. С. 9-17
Цель. В статье на основе презентации ежегодного аналитического доклада «О состоянии правовой охраны, использования и защиты интеллектуальной собственности в Российской Федерации, ЕАЭС и СНГ», подготавливаемого в РНИИИС и представленного автором на XI Международном форуме «Инновационное развитие через рынок интеллектуальной собственности», прошедшем в Москве в МГИМО 23 апреля 2019 г., анализируются состояние, основные проблемы и перспективы государственного регулирования формирования и развития евразийского рынка интеллектуальной собственности в России, других странах ЕАЭС и СНГ, при создании единого экономического пространства и переходе к цифровой экономике. Результаты. Подробно на основе сравнительного анализа исследуются рейтинги и показатели результативности научных исследований и разработок, новые риски и вызовы интеллектуальной собственности и предлагаются подходы и практические решения с позиций обеспечения конкурентоспособности национальных экономик как стран ЕАЭС, так и Евразийского экономического Союза в целом. Основные выводы и рекомендации были представлены автором также на Всемирной конференции ВОИС «Интеллектуальная собственность и развитие: как использовать потенциал и извлечь выгоду из системы интеллектуальной собственности» 20 мая 2019 г.в Женеве (Швейцария) и получили поддержку в решении Комитета ВОИС по развитию интеллектуальной собственности (23-я сессия КРИС ВОИС от 21 мая 2019 г.).

Problems of formation of the Eurasian intellectual Property Market in 2018 and Priorities for the Future until 2025 as a Condition of competitiveness in the digital Economy
Purpose. The article analyzes the situation and basic problems of state regulation of the formation and development of intellectual property market in Russia, the CIS and the Eurasian Economic Union in 2018, identified the reasons why systematically thwarted time and not achieved the expected results in politics, economics and law at the decision of problems of formation of the modern civilized intellectual property market as one of the key conditions for innovative development and the transition to a digital economy. Results. Detail on the basis of a comparative analysis investigates the performance indicators for assessing the effectiveness of research and development and their importance for the formation of the economy of intellectual property as a condition for innovative development; new risks to intellectual property are identified and approaches and practical solutions based on the mechanisms of regulation of «soft power» — including in the digital economy and management in the innovative development and competitiveness.

В статье на основе доклада, представленного автором на XI Международном форуме «Инновационное развитие через рынок интеллектуальной собственности» от имени РАН, описываются проблемные вопросы обеспечения конкурентоспособности академической науки при переходе к цифровой экономике и роль РНИИИС в их выявлении, изучении и выработке подходов и инструментов по их решению.

Развитие и защита конкуренции: новые вызовы для государства и науки С. 21-24
В статье, на основе доклада автора, представленного в рамках XI Международного форума «Инновационное развитие через рынок интеллектуальной собственности», рассматриваются вопросы совершенствования государственной политики в сфере защиты и развития конкуренции в условиях новых цивилизационных вызовов. Успешность экономического развития России во многом зависит от решения наукоемких проблем антимонопольного регулирования, в том числе проблем развития и защиты конкуренции в научной сфере с учетом показателей экономики интеллектуальной собственности. Предлагается разработать с участием заинтересованных органов власти и ученых проект «дорожной карты» развития конкуренции в сфере науки, который бы включал пакет нормотворческих и управленческих решений, обеспечивающих полноправное участие ученых (в том числе самозанятых), временных научных коллективов и объединений ученых, не являющихся юридическими лицами, в государственных и муниципальных закупках НИР и НИОКТР. Обосновывается необходимость разработки автоматизированной системы выявления, предупреждения и пресечения картелей антимонопольными органами (с учетом опыта участия ряда академических институтов в разработке для нужд Росфинмониторинга автоматизированной системы выявления и анализа подозрительных финансовых операций). Обоснована важность проведения Российским фондом фундаментальных исследований конкурса ориентированных фундаментальных исследований для решения проблем антимонопольного регулирования в новых экономических реалиях.

Development and protection of competition: new challenges for the state and science
The article deals with the improvement of state policy in the field of protection and development of competition in the face of new civilizational challenges. The success of Russia’s economic development largely depends on the solution of high-tech antimopolistic regulation problems, including the problems of development and competition protection in the scientific sphere. It is proposed to develop with the participation of interested authorities and scientists a draft “roadmap” for the development of competition in the field of science, which would include a package of rule-making and management decisions ensuring the full participation of scientists (including self-employed), temporary research teams and associations of scientists who are not legal entities in government procurement of scientific research and its results. It justifies the need to develop an automated system for detecting, preventing and suppressing cartels by antimonopoly authorities (taking into account the experience of participation of a number of academic institutions in the development of an automated system for identifying and analyzing suspicious financial transactions for the needs of Rosfinmonitoring). It justifies the importance of the Russian Foundation for Basic Research, a competition of oriented basic research for solving the problems of antitrust regulation in new economic realities.

Современные проблемы защиты интеллектуальной собственности в условиях формирования рынка интеллектуальной собственности С. 25-30
В статье на основе доклада, представленного автором на XI Международном форуме «Инновационное развитие через рынок интеллектуальной собственности», прошедшем в Москве в МГИМО 23 апреля 2019 г., анализируются основные проблемы защиты интеллектуальной собственности в административном, гражданско-правовом и уголовном порядке в условиях формирования рынка в этой сфере экономических отношений. Автор выделил главные характеристики социальной среды, основные факторы и условия формирования рынка интеллектуальной собственности и проблемы конкурентоспособности в странах ЕАЭС на национальном, региональном, отраслевом и корпоративном уровнях. Результаты. Системный анализ законодательства и судебной практики по защите интеллектуальной собственности позволил автору обозначить основные тенденции и сформулировать конкретные предложения по повышению эффективности защиты интересов правообладателей в рамках межгосударственного сотрудничества в этой сфере.

Actual Problems of Intellectual Property Protection in Terms of the Market Formation in this Area
The purpose of the Research is to identify the main Problems of intellectual property protection in administrative, civil and criminal procedure in the Conditions of market formation in this sphere of economic relations. The Author highlighted the main Characteristics of the social Environment, the main Factors and Conditions for the Formation of the intellectual Property Market and the Problems of competitiveness in the EAEU countries at the national, regional, sectoral and corporate Levels. Methodology: comparative legal method of research helps to identify common and special features inherent in the judicial Protection of IP in various types of proceedings. In particular, the Statistics and judicial Practice of Russian Courts on IP protection in administrative, civil and criminal proceedings were studied. Formal-logical (analysis, synthesis, induction, deduction), as well as legal-dogmatic Methods are used in the Analysis of normative legal Acts and judicial Practice, the Definition of the modern social Environment. On the Basis of the system (structural and functional) Method, the Place and Role of the Ideas of individual freedom and social solidarity in the Formation of the Strategy of cooperation of States in the Field of IP protection is revealed. Result. The System analysis of legislation and judicial Practice on intellectual Property protection allowed the Author to identify the main Trends and formulate specific proposals to improve the Protection of the Interests of right holders in the Framework of international cooperation in this Field. For effective IP judicial Protection within the framework of the Eurasian economic Union (hereinafter the EAEU), it is necessary to develop a Strategy for the unification of national legislation and judicial Practice of the Members of the Union or the Creation of unified interstate judicial bodies standing over national Courts

Итоги XI Международного форума ≪Инновационное развитие через рынок интеллектуальной собственности≫ С. 31-34
В рамках Международных дней интеллектуальной собственности под эгидой ООН в МГИМО МИД России (Москва) 23 апреля 2019 г. состоялся очередной XI Международный форум «Инновационное развитие через рынок интеллектуальной собственности». В рамках Форума прошло два пленарных и шесть специализированных сессионных заседаний, на которых было представлено более 70 научных докладов. К особенностям ХI форума можно отнести следующее. Первое — это заостренность на евразийских проблемах. С 2016 г. Евразийская экономическая комиссия выступает соорганизатором Международного форума, и поэтому в работе форума и на сессионных заседаниях представители ЕЭК и всех стран ЕАЭС принимают участие. Второе — это цифровая экономика, актуальные вопросы которой через призму интеллектуальной собственности вынесены практически на всех заседаниях Форума. Третье — это практическая заостренность не только на обсуждении проблем и их причин, но и подходов и механизмов их решения, что объясняет презентацию и профессиональное обсуждение на Форуме четырех новых проектов ГОСТ, как механизмов регулирования «мягкой силы» по этим вопросам. Четвертое — поиск совместных решений по обеспечению конкурентоспособности и лидерства ЕАЭС за счет использования национальных преимуществ в отдельных отраслях экономики в рамках евразийской интеграции (энергетика — космическая отрасль — авиастроение — судостроение — ОПК). Итоги и рекомендации участников Форума направлены в адрес руководителей органов власти, науки и бизнеса стран СНГ и ЕАЭС, а также в адрес руководителей международных организаций (ВОИС, ЕС, ЮНЕСКО, ВТО, ШОС). Полученные от данных органов отзывы подтверждают актуальность вопросов, ежегодно рассматриваемых в рамках международного форума и выработанных его участниками рекомендаций. В статье освещаются кратко его итоги.

On the results of the XI International Forum “Innovative Development through the Intellectual Property Market”
On April 23, 2019, the XI International Forum “Innovative Development through the Intellectual Property Market” was held in Moscow as part of the International Days of Intellectual Property under the auspices of the United Nations (on the basis on MGIMO (University) run by the Ministry of Foreign Affairs of Russia), which participants represented WIPO, SCO, CIS, Eurasian Economic Commission of the EEU, Union State, state authorities, institutions of science and education, business and public organizations, mass media of all EEU member states and 17 regions of Russia, including via videoconference on the regional sites (on the basis of the Ural State Economic University, Yekaterinburg, the Crimean Federal University named after Vernadsky, Simferopol), as well as delegations of the Arab countries. The on-line mode of the Forum’s video broadcast on the its organizers’ websites allowed an almost unlimited circle of interested participants to take part in its work, both in Russia and abroad. The Forum Organizers included Executive Committee of the CIS and Eurasian Economic Commission of the EEU; The Russian Academy of Sciences; Intellectual Property Corporation RSRIIP; Association of Lawyers of Russia; MGIMO (University) run by the Ministry of Foreign Affairs of Russia; with the support of the Russian Foundation for Basic Research (RFBR grant № 19-011-20019). All these years, the Directorate and Sponsor of the Forum is the Republican Scientific Research Institute of Intellectual Property (RSRIIP), the only scientific non-profit organization in the EEU and CIS countries that specializes in intellectual property and provides services in this area at the level of international ISO standards. Two plenary meetings and six specialized in-session meetings took place within the framework of the Forum, during which more than 160 representatives of 4 science academies and 7 academic organizations, representatives of 23 universities, 13 ministries and departments of the Russian Federation, 19 main state corporations and banks, mostly — scientists, including 8 academicians of the state science academies, 41 doctors of science (Ph.D) and 50 candidates of science in the various scientific fields. More than 70 scientific reports were presented during the Forum. The article briefly highlights its results. The next XI1 International Forum “Innovative Development through the Intellectual Property Market” will be held on April 23, 2020 in Moscow. 20 мая 2019 г. в Женеве (Швейцария) состоялась Всемирная конференция ВОИС на тему «Интеллектуальная собственность и развитие: как использовать потенциал и извлечь выгоду из системы интеллектуальной собственности». В работе конференции приняло участие более 1000 человек из государств — членов ВОИС (190 стран). На четырех сессиях конференции были рассмотрены 1) преимущества системы интеллектуальной собственности для инноваций, 2) как она способствует творчеству и 3) решению глобальных проблем, а также 4) проблемы и возможности системы интеллектуальной собственности в современном мире. Открыл конференцию г-н Фрэнсис Гарри, генеральный директор ВОИС. С основными докладами в рамках деловой программы Форума выступили 17 спикеров, представляющих 12 стран мира и международные организации. От стран ЕАЭС и СНГ свой доклад представил Владимир Лопатин — научный руководитель РНИИИС, в котором он отразил основные выводы и рекомендации XI Международного форума «Инновационное развитие через рынок интеллектуальной собственности», прошедшего 23 апреля 2019 г. в рамках Международных дней интеллектуальной собственности под эгидой ООН. Положения доклада получили высокую оценку и поддержку в решении Комитета ВОИС по развитию интеллектуальной собственности (23-я сессия КРИС ВОИС от 21 мая 2019 г.). В данном обзоре приведены краткие итоги Всемирной конференции ВОИС.

Benefits and future of intellectual Property in the World
May 20, 2019 the WIPO World Conference on «Intellectual Property and Development: how to harness the Potential and Benefit from the intellectual Property System» was held in Geneva (Switzerland). The Conference was attended by more than 1,000 people from WIPO member States (190 countries). Four sessions of the Conference addressed (1) the benefits of the intellectual Property System for innovation, (2) how it contributes to creativity, and (3) addressing global challenges, as well as (4) the challenges and opportunities of the intellectual Property System in today’s World. The Conference was opened by Mr. Francis Gurry, Director General of WIPO. 17 speakers representing 12 countries of the World and international organizations made keynote speeches in the framework of the business Program of the Forum. Vladimir Lopatin, scientific Director of RNIIIS, presented his report from the EAEU and CIS countries, which reflected the main Conclusions and Recommendations of the XI International Forum «Innovative development through the intellectual Property Market», held on 23.04.2009 within the framework of the international Days of intellectual Property under the auspices of the UN. The Report was highly appreciated and supported by the decision of the WIPO Committee on intellectual Property Development (23rd session of the WIPO CRIS dated 21.05.2009). This review summarizes the Results of the WIPO world Conference.
